Terms and Conditions

These Terms and Conditions govern the EVES Realty Limited (“Promoter”) Appraisal and Listing Incentive Competition (“Competition”). By participating, you agree to abide by these Terms and Conditions.

1 Eligibility

1.1.  Who Can Enter
To enter the Competition, the participants must:
(a)be New Zealand residents aged 18 years or older;
(b)own a property located within the Bay of Plenty or Eastern Bay of Plenty regions; and
(c)not be Employees, salespersons, managers, directors or immediate family members of EVES Realty Limited, or anyone professionally connected with the Competition.

1.2.  Eligible Appraisals and Listings
The following appraisal, listing and property criteria will apply for entry:
(a)The property must be appraised by an EVES salesperson between 1 October 2025 and 31 October 2025 (“Competition Period”).
(b)The property must be listed for sale exclusively with an EVES salesperson between 1 October 2025 and 31 October 2025 (“Competition Period”).
(c)Properties outside the Bay of Plenty and Eastern Bay of Plenty region and rental listings are not eligible for entry. 

2 Entry

2.1 Entry Requirements
To enter the Promotion, Eligible Entrants must
(a)book and complete an Appraisal for a property they own with an EVES salesperson (Qualifying Appraisal Entry). Each Eligible Entrant who completes a Qualifying Appraisal Entry will be entered into the Prize Draw automatically. Or:
(b)list a property for sale exclusively with an EVES salesperson (Qualifying Listing Entry). Each eligible Qualifying Listing Entry will be entered into the Prize Draw automatically.

2.2 Entries Permitted
Qualifying Appraisal Entries will be limited to one (1) entry for each residential property owned by an Eligible Entrant. If more than one Appraisal is conducted for the same residential property, only the first Appraisal will be deemed to be a Qualifying Appraisal Entry. Qualifying Listing Entries will be limited to one (1) entry for each residential property owned by an Eligible Entrant. Each entry must be submitted in accordance with the entry requirements outlined in these Terms and Conditions. The Promoter reserves the right to disqualify any entrant who provides false information, fails to meet eligibility requirements, or breaches these Terms and Conditions.

3 Prize details

3.1.  Number of Prizes
One winner will be selected.

3.2.  Prize Description
The winner will receive a travel voucher worth NZD $3,500 ("Prize"). The voucher can be used as the winner wishes on flights, accommodation and / or other activities, within the voucher value.

3.3.  Prize Conditions
The Prize is:
(a) non-exchangeable, and cannot be redeemed for cash;
(b) any costs exceeding the voucher value are the responsibility of the winner; and
(c) it is subject to the specific terms regarding voucher redemption, expiration, and usage.

4 Prize draw

4.1 How the prize will be drawn
A random electronic draw of all Qualifying Entries will take place 247 Cameron Road at 1:00pm NZDT on Tuesday 4th November 2025, and 1 (one) Qualifying Entry will be drawn from all Qualifying Entries for the Prize. The draw will be conducted by the Promoter and will be entirely random.

4.2 Notification and claiming the prize
The Promoter will notify the winner of the Prize Draw in writing by email, or by phone call, via the details provided. The winner of the Prize Draw must claim the Prize within 14 working days of being notified. The Promoter will provide the Prize to the winner via voucher. If the winner of the Prize Draw fails to claim the Prize in accordance with the above, the winner will be taken to have forfeited the Prize and the Promoter will then offer the Prize to the winner of the Unclaimed Prize Draw

4.3 Unclaimed Prize Draw
If the Prize is not claimed by the winner of the Prize Draw in accordance with the Terms and Conditions, an unclaimed prize draw will be held on 25th November 2025. All Qualifying Entries (except the Qualifying Entry drawn in the Prize Draw) will be entered in the unclaimed prize draw and one (1) Entry will be randomly drawn.

The Promoter will notify the winner of the Unclaimed Prize Draw by email, or phone call. The winner of the Unclaimed Prize Draw must claim the Prize within 10 working days of being notified. 

5 Privacy and General terms

5.1 It is a condition of entry into the Promotion that entrants provide the Promoter with their correct first and last name, and valid contact number and email address. Where an entrant's contact details change at any time after entering the Promotion and before the date of the Prize Draw, the entrant must notify EVES of their correct contact details immediately. Any entries will be void if the correct contact details are missing or invalid. The Promoter is not responsible for any incomplete or incorrectly submitted details provided by an entrant. 

5.2 The results of the Prize Draw (and any Unclaimed Prize Draw) are final and no correspondence will be entered into.

5.3 It is a condition of accepting Prize that the Prize Winner agrees to:
(a) the publication of their name, and/or region of residence in accordance with these Terms and Conditions;
(b) participate in all publicity reasonably requested by the Promoter in connection with the Promotion (and the Prize);
(c) consent to the use of their name, image and likeness in any media for an unlimited period without remuneration in connection with the Promotion (and the Prize), and for promotional purposes related to the Promoter and/or its licensees; and
(d) at the Promoter's reasonable request, do all things necessary (including signing all documentation) necessary to give effect to this clause and/or to enable the Promoter to provide any part of the Prize. 

5.4 All entries become the property of the Promoter. Entrants consent to the Promoter using personal information provided in connection with the Promotion for the purposes of facilitating the conduct of the Promotion, awarding any Prizes (including to third parties involved in the Promotion and any applicable statutory authorities) and providing marketing communications.

5.5 The Prize must be taken as stated and no compensation will be payable if the Prize Winner is unable to use the Prize as stated. 

5.6 The Promoter accepts no responsibility for any costs or expenses associated with use of the Prize.

5.7 Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Consumer Guarantees Act 1993.

5.8 Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter, its licensees and related entities (including its respective directors, officers, employees and agents) are not responsible for and exclude all liability (including negligence), for any loss or damage (including loss of opportunity), whether direct, indirect, special or consequential, arising in any way out of any use or taking of the Prize.
